TERMS OF SERVICE
Article 1 – Definitions
The following definitions apply to these Terms and Conditions:
Company / We / Us:
North & Willow.
Customer / You:
Any individual who places an order through our website for personal, non-commercial use.
Day:
A calendar day.
Order:
A request placed by the customer to purchase products via our website.
Product:
Any physical item offered for sale by North & Willow.
Distance Contract:
A contract concluded electronically via our website without physical contact between the parties. Provincial consumer protection legislation may apply to distance contracts, including the Ontario Consumer Protection Act, 2002.

These Terms & Conditions of North & Willow.
Article 2 – Applicability
These Terms and Conditions apply to all offers, orders, and agreements between North & Willow and the customer.
By placing an order, the customer confirms acceptance of these Terms & Conditions.
If any provision of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions shall remain fully effective. Any invalid provision will be replaced by a provision that most closely reflects the original intent.
Article 3 – The Offer
All product descriptions, images, specifications, and prices on our website are provided as accurately as possible.
However:
- Images are for illustrative purposes only
- Colour variations may occur due to screen settings
- Minor errors or inaccuracies do not bind North & Willow
We reserve the right to modify or discontinue any offer without prior notice.
Article 4 – The Agreement
A contract is formed once:
- The customer places an order, and
- Payment is successfully completed
We reserve the right to refuse or cancel an order if:
- Payment cannot be verified
- Incorrect information is provided
- Fraud or abuse is suspected
Order confirmation will be sent electronically via email.
Article 5 – Prices & Payments
All prices are listed in Canadian Dollars (CAD $).
The prices displayed on our website include all applicable taxes and shipping costs. Since delivery originates from outside Canada (China), we ship all orders DDP (Delivered Duty Paid). We cover all applicable import duties, taxes, and customs clearance fees. The buyer will not incur any additional costs upon delivery by the postal or courier service.
We are not responsible for pricing errors. If a pricing error occurs, we reserve the right to cancel the order and issue a refund.
Article 6 – Shipping & Delivery
Orders are shipped to the address provided by the customer at checkout.
Estimated delivery times are indicative, not guaranteed.
We are not liable for delays caused by:
- Customs clearance
- Courier delays
- Incorrect address details
- Force majeure events
Risk of loss transfers to the customer upon delivery.
Article 7 – Returns & Right to Cancel
Customers may request a return within 30 days of delivery, subject to our Return & Refund Policy.
Key points:
- Returns are not free; return shipping costs are the responsibility of the customer for change-of-mind returns
- All returns must be approved before shipment
- Items must be unused, unworn, and in original packaging with tags attached
- If you receive a damaged, defective, or incorrect item, please contact us within 48 hours — we will cover return shipping and provide a replacement or refund
Certain items (including hygiene products and custom-made items) are non-returnable.
Nothing in this policy limits your statutory rights under applicable Canadian consumer protection legislation, including the Ontario Consumer Protection Act, 2002, which may provide additional cancellation rights for distance contracts.

Article 8 – Refunds
Approved refunds will be issued to the original payment method within 10 business days after inspection.
Refunds will not be issued if:
- Return conditions are not met
- Items are damaged due to misuse
- The return arrives at an incorrect address
Article 9 – Exchanges
Customers may request one exchange within 30 days of delivery.
- Exchange shipping costs are the responsibility of the customer
- Replacement items are shipped after approval
- Availability of requested items is not guaranteed
- If the requested item is unavailable, a refund will be issued in accordance with Article 9
Article 10 – Damaged, Incorrect, or Missing Items
If an item is damaged, incorrect, or missing:
- Contact us at support@northwillow.ca
- Provide photos/videos and order number
- Claims must be reported within 48 hours of delivery
We will assess each case and provide an appropriate solution, which may include a prepaid return label, replacement, or refund at our discretion.
Article 11 – Warranty & Product Use
Products are provided "as is" and intended for personal use only.
Warranty does not apply if:
- Products are misused or altered
- Normal wear and tear occurs
- Damage results from improper handling
We are not responsible for suitability for a specific purpose unless explicitly stated.
Article 12 – Liability
North & Willow is not liable for:
- Indirect or consequential damages
- Delays beyond our control
- Loss caused by incorrect customer information
Our liability shall never exceed the value of the order.
Article 13 – Force Majeure
We are not responsible for failure or delay caused by events beyond our reasonable control, including but not limited to:
- Natural disasters
- Customs delays
- Carrier disruptions
- Government actions
Article 14 – Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any disputes shall be resolved in accordance with applicable Canadian law.
